I sure wish I could appeal. I received 500.00 but according to the occ chart I should have received 15,000.00 which would be a start to repair my credit that has completely been ruined. Wells fargo would start modification and after the trial period they would almost triple my payment making it impossible to modify they did this to me 4 times in 2 years.

I filed a complaint directly to the OCC 11-28-2011 and was given Case #01887017. I also filed for review of my foreclosure in the Independant Foreclosure Review 12-28-2011 and was given Ref.# 1811662791. The case filed with the OCC should have concluded in about 90 days. The OCC deliberately held up giving me a decision for over a year and two months pretending to need information from BoA they already had. Finally on January 30, 2013 I recieved a letter from the OCC stating that my case with the OCC was being dismissed because it was in the scope of the IFR. I filed an appeal. Prior to the dismissal I had been told by the OCC Houston Office Manager Ms. Melinda Goodnight that Mr. Larry Hattix instructed them not to review case and to dismiss all cases like mine. The OCC has thousands of claims filed directly to them they refuse to review and dismissed to keep the harm the servicers did to us hidden. My case was dismissed January 30, 2013 because it feel in the scope of the IFR. By the way I am one of the 53 foreclosed on who was not in default and one of the 2800 original cases reviewed by the OCC in 2010. The things done in regards to the IFR were conspired and more than poor management at work. I am also one of 250 borrowers complaints reviewed by 39 state attorney generals posted on the internet April 29,2009. Check it out

A couple of notes:

One of the ways the banks are reducing principal and foreclosing anyway is that, when the bank hold both the first and second mortgages on a property, they can write off the second mortgage and then foreclose on the first. They get the benefit of principal reduction and foreclose on the same property.

Second, I'm always curious that, given that 40% of the households affected by the foreclosure crisis were tenants, there was no requirement that lenders pay back the security deposits that tenants lost in being evicted (often illegally) from foreclosed properties. Tenants Together in California determined that 60% of tenants evicted from foreclosed properties never received a sou of their security deposits.

Here is the 411 on the "INDEPENDENT FORECLOSURE REVIEW" Rust Consulting sends your docs to the bank....the bank then has the option of reviewing your file and they can take out docs if they so desire. The personnel that review the files are Temps hired by the bank with very little experience. The bank trains them and pays the temp agency so who is the boss. There is no consulting firm on site to oversee the review. Check an article on www.nakedcapitalism.com. Actual comment by a Temp hired by the bank. I even call one of the temp agencies to confirm. So again the banks are getting away with murder. If we think they will compensate us for damage, thing again

Interesting that all these fiducuary entities are offering help to new buyers. Why the Hell didn't they do more to try to help the original owners? If the property I owned is NOW selling for $39,500 after I had already paid $30,000 DOWN, AND over $40,000 in pmts? I would have gladly taken over a new loan on the true value of the place. Whatever the origin of this debaucle, it has to be VERY DEEP. There's a "few" people making more money then most of us could see in 10 lifetimes.
